5 Years Warranty Policy
ESCORTS LIMITED NEW TRACTOR WARRANTY POLICY
Escorts Limited ("Escorts") warrants that each new Tractor sold shall be free from any defects in material and workmanship, under normal usage, maintenance and service, subject to the following terms and conditions:
1. Pre-Conditions for availing Warranty
(a) The Tractor must have been operated in accordance with the operating instructions contained in the operator's manual delivered with the Tractor.
(b) The Tractor must have been serviced regularly, at the required intervals (free as well as paid) at Authorized Escorts Dealer Service Network only. It is the owner's responsibility to avail all the free/paid services at scheduled times as provided in the operator's manual to avail the benefits of this Warranty.
(c) The Owner of Escorts Tractor to ensure usage of only those Consumables / Parts, which are recommended by Escorts or its Authorized Dealer workshop and which need to be replaced at regular intervals. The owner has to pay for necessary labour and consumables required during the periodic maintenance checks and shall also keep an accurate service record thereof.
(d) The Tractor has to be brought to Escorts Authorized service centre/dealership by owner for any Warranty repair. At the time of repair, the Owner has to bring along with him the Original Invoice/Owner manual for any Warranty claim. In case of absence of Invoice/Owner manual, giving Warranty claim, the decision to provide Warranty claim or not, lies solely at the discretion of Escorts Only.
2. Term
The term of the warranty provided hereunder shall be for a period of five (05) years or upto a maximum of five thousand (5000) usage/ running hours, whichever is earlier, from the date of delivery to the first purchaser/owner.
This warranty is transferable to subsequent owner for the remaining warranty period. This warranty is applicable within the territory of India and not transferable to any other jurisdiction.
The detailed terms and conditions of the Warranty are as detailed hereunder.
3. Terms and Conditions of Warranty
(a) The Warranty shall be for a period of five (5) Years or upto a maximum of five thousand (5,000) usage/ running hours, whichever is earlier, from the date of delivery, strictly limited to the parts mentioned in Section 4, 5 and 6 below.
(b) The running hours meter should be working in a proper manner without any damage or fault.
(c) The Tractor must be delivered by an authorized Dealer of Escorts and all the routine services (both free and paid) should have been done on timely basis only from an Escorts Authorized Dealer/ Service Centre.
(d) Escorts obligations (within stipulated time as mentioned herein) under the Warranty is limited to the replacement of any part shown to be defective with a new part or the equivalent, without charge to the Owner for parts and labor costs. However, Escorts reserves the right, at its sole discretion to determine whether the said part is defective and is required to be replaced or repaired.
(e) The Owner of the Tractor is responsible for any repair or replacements which are not covered under the Warranty.
(f) Escorts will be the owner of each and every part replaced under the Warranty.
(9) This Warranty policy is subject to revision from time to time and shall apply to the customer which is in effect at the time of delivery to the original Owner.
(h) The Warranty cannot be clubbed with any other scheme floated by Escorts, unless and until it is pre- approved by Escorts.
WARRANTY
4. The warranty for the parts as mentioned in this Section 4 shall be limited for a period of one (1) Year or up to a maximum of one thousand (1,000) usage/running hours, whichever is earlier.
(a) Sheet metal components - Front and rear wheel rims, Fenders, Bonnet, Hood, Rear hood, Centre panel, Radiator shell, Foot board, Muffler, Alternator cover, Tow-hook, Hitch/ draw-bar, Air cleaner assy. (except filter element), Driver seat, Stickers & Decals, Chassis frames & Brackets, Accelerator cable.
(b) Electrical components - Electrical feed pump, Head lamp, Sensors & Switches,, wiring harness, Tail lamps, Plough lamp,, Trailer socket, fuel float Unite trump Schuster, Indicators, Flash unit, Horn push button.
(c) External engine cooling system - Radiator, Recovery tank, Fan belt, Radiator fan, Water pump. Engine pulley. Thermostat, Pre cleaner hoses, oil seal, "O" rings and pipes.
(d) Front Axle assembly - Bearings, Seals, Bushes, Tie-rod ends.
(e) Hydraulics - Hydraulic pump/ Tandem pump, lifting rod, lifting arms, sensing spring. Three Point linkage (Lower link, Top link), Check-chain, Stay-bar, Oil seals, pipes and bearings, Relief Valve. Control Levers, Auxiliary Valve, Quadrant Assembly, Sensing Spring.
(f) Steering system - Power steering motor, Gear assemble steering (SDA), Power steering reservoir, Steering wheel, Steering hoses, Power Steering Cylinder, Inner Column, Rocker Shaft, Steering Knuckle, Drop Arm, Steering Arms, Tie rod & Drag link (excluding bend cases), Oil seals & Dust seals.
(g) Transmission - Oil seals, Ball & guide gear shifter.
(h) Clutch-Driven plates (except wear & tear), Pressure plates, Clutch pedal and linkages, Oil seals.
5. The warranty for the parts as mentioned in this Section 5 shall be limited for a period of two (2) Years or up to a maximum of two thousand (2,000) usage/running hours, whichever is earlier.
(a) Engine
Valves and valve guides (excluding burnt and pitted valves), Inlet & Exhaust manifolds, Main oil seal, timing seal, crank pulley, oil sump, oil strainer, Governor Control Linkages.
(b) Front Axle
Front Axle (Excluding Bearings/Seals/ Bush), Front Axle Extension, Front Axle Support.
6. The warranty for the parts as mentioned in this Section 6 shall be limited for a period of five (5) Years or up to a maximum of five thousand (5,000) usage/running hours, whichever is earlier.
(a) Engine
Oil pump & drive, Crankshaft, Thrust bearing, connecting rod, Gudgeon pin, Piston (Excluding Seizure), Engine block, Cylinder head, Gear, Flywheel ring gear, Camshaft, Cam follower, Valve gear, Cylinder Bore/liner/sleeves, timing cover, Crankcase, Front Cover, Timing Gears.
(b) Transmission (Gear Box, Differential, Rear Axle)
Transmission Cover, Transmission Gears, Couplings, Shafts, synchromesh rings and hub, Housings, Retainers, Shifter Forks, Rails, Differential Housing, Bull Gear, Crown Wheel and Pinion, Differential Gears & Pinions, Differential Shafts, Rear Axle Carrier, Rear Axle housing. Propeller shaft, Front axle assembly - 4W (Housing subassembly, Crown wheel, pinion, Star gears Axle shaft Left Hand/ Right Hand, Carrier assembly).
(c) Hydraulics
Hydraulic housing/ram cylinder including piston assembly, Hydraulic Distributor/regulator valves, serration shaft.
(d) Bearings
Engine Main Bearings, Thrust Bearing, Connecting Rod Bearing, Gear Box Bearings, Differential Bearings, Rear Axle Bearings (Bearing failure under warranty is acceptable only if greasing & oil replacement is done at specified interval or earlier depending upon the type of application).
(e) Fasteners
Main Bearing Cap Bolts, Con Rod Bolts, Cylinder Head Bolts, and Differential Side Bearing bolts.
7. Exclusion in warranty policy
Following items and services are excluded from the Warranty:
(a) Normal maintenance services such as fuel system cleaning, wheel brake and clutch adjustments.
(b) Normal replacement of service items due to wear and tear (e.g. filters, fuel injectors, brake or clutch Linings, rubber parts, plastic parts, sealing).
(c) Warranty shall not be offered on Parts that are subject to fast wear and tear and to expandable and consumable items, including but not limited to rubber or plastic items, clutch plates, brake plates, seat cushions and air, fuel or oil filters, engine oil and hydraulic oil, hoses and fan belts, light bulbs and to damage or deterioration of exterior finish due to normal use or exposure.
(d) Tractor which has been subjected to misuse, negligence, alteration, accident, submerged in water, any abnormal use, in race or any other competition or if genuine spare parts have not been used or replaced.
(e) Parts of the tractor those have been altered or replaced by an unauthorized technician or dealer.
1) Loss of use of the Tractor, loss of time; inconvenience, or other consequential damage which includes, ( loss or damage to personal property or expense of returning damaged units to the authorized Escorts dealer/Service centre.
(g) If any component specification is altered/tampered like Fuel pump delivery altered, Hydraulic Pressure altered beyond Escorts operating specified range, electrical components if altered/abnormal fuel usage etc.
(h) Tractor is not used with specified standard implements which is not as per the specification of the tractors laid down by Escorts, or is either used for heavy haulage i.e. load carried which is more than the approved weight as prescribed in the operator manual.
i) Any Acts of God such as flood, cyclone, earthquake, fire, lightning strike or any other natural calamity.
(1) Any type of legal liability, consequential loss (whether direct or indirect), damage to occupants or third party
(k) Breach in any manner whatsoever of any of the terms or guidelines contained in the operator manual or as issued by Escorts from time to time.
(1) Tractor which has been modified or altered, including without limitation, the installation of performance accessories.
(m) Tractor which has not been received, during the warranty term for service inspections prescribed in the Owner's Manual and Service Booklet.
8. Warranty Repairs
(a) When a part is to be replaced under this Warranty, the smallest subassembly possible, as shown in the Escorts parts catalogue, will be used.
(b) Parts repaired or replaced under this Warranty will be warrantable for the balance of the original warranty tenure, as mentioned hereinabove.
(c) Only "ESCORTS LIMITED GENUINE PARTS' will be considered under warranty.
9. Design changes
Since improvement is a continuous process hence Escorts reserves the right to carry out any changes or modifications in design and/or specifications whatsoever in any product/part manufactured at. Escorts, without prior information, to make the product better than before or in line with industry standard/market practices. Change on specification of a component shall not be deemed that an earlier tractor fitted with component of previous specification is of poor or inferior workmanship and entitle any upgrade of the components.
10. Proprietary Component Claims
Warranty claims on proprietary components such as tyres, fuel injection equipment, auto electrical respective (Starter motor. Alternator) components, as dealer to the liable in an original equipment manifested battery have to be referred directly to and Escorts shall not be in any manner in respect of the same.
Please refer to Annexure 1 for the applicable warranty period of proprietary items.
11. Disclaimer of Consequential Damages
Escorts assumes no responsibility for loss of vehicle, loss of time, inconvenience or any other indirect incidental or consequential damage resulting vehicle loss of time, inconceivable to the purchaser/owner because of any defect covered by this warranty
12. Governing Laws and Jurisdiction
The validity, construction and performance of this Warranty policy shall be governed by the laws of India and the purchaser/owner agree to submit to the exclusive jurisdiction of the Courts at Faridabad, Haryana, India.
